SDK license
The Concierge SDKs (the iOS framework, the Android library, the React Native package, the Flutter plugin and the web package, together the “SDK”) are proprietary software owned by Pixel Port LLC (“Concierge”). They are distributed only in binary, compiled or minified form, together with the small integration files a package needs to build (for example the React Native bridge files, the Expo config plugin, the Flutter plugin’s Dart API and platform bridge, and type definitions). Source code is not provided.
- Grant. You may download, install and use the SDK, and distribute it as an unmodified part of your own applications, free of charge, for the purpose of connecting those applications to a Concierge account. Use of the Concierge service is governed by the Terms of service, and processing of your end users’ data by the Data processing agreement.
- Restrictions. You may not (a) sell, sublicense or redistribute the SDK on its own, (b) modify, decompile, disassemble or reverse engineer the SDK, except to the extent applicable law expressly permits it despite this restriction, (c) remove or alter any proprietary notices, (d) use the SDK to build a product that competes with Concierge, or (e) remove, hide or obscure the AI label the SDK shows on AI written replies.
- Ownership. Concierge keeps all rights, title and interest in the SDK. No rights are granted except as stated in this license.
- Data. The SDK sends the data described in the platform docs to the Concierge service, and only when the chat is used or a push token arrives; it makes no network call at app launch. You are responsible for telling your users about it in your app’s privacy policy and store privacy labels.
- Third party components. The SDK may rely on open source libraries (for example, on Android, OkHttp and kotlinx.serialization under the Apache License 2.0), which are fetched by your build tool under their own licenses and are not covered by this license.
- Termination. This license ends automatically if you breach it or no longer have a Concierge account. On termination you must stop distributing new builds of your applications that contain the SDK. Copies already installed by your users may keep running, but the service may stop answering them.
- Your app. You are responsible for your applications, for testing every build that includes the SDK, for your app store submissions and privacy labels, and for complying with the rules of the platforms you distribute on. We do not promise that the SDK will pass app review or work with every device, OS version, framework or third party library.
- No warranty. THE SDK IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON INFRINGEMENT, AND ANY WARRANTY THAT IT WILL BE ERROR FREE, SECURE OR UNINTERRUPTED.
- Limitation of liability. TO THE FULLEST EXTENT THE LAW ALLOWS, PIXEL PORT LLC IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, OR FOR APP CRASHES, STORE REJECTIONS OR REMOVALS, ARISING FROM OR IN CONNECTION WITH THE SDK OR ITS USE. ITS TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SDK IS PART OF, AND NOT IN ADDITION TO, THE SINGLE AGGREGATE CAP IN SECTION 9 OF THE TERMS OF SERVICE (THE GREATER OF THE FEES YOU PAID IN THE 3 MONTHS BEFORE THE CLAIM AROSE AND US$50). These limits do not apply to liability that cannot be limited by law.
- Indemnity. You will defend and indemnify Pixel Port LLC against third party claims arising from your applications or your breach of this license, as set out in section 10 of the Terms of service.
- Export. You will not export or use the SDK in breach of export control or sanctions laws.
- Law and disputes. This license is governed by the laws of the State of Florida, United States. Disputes are resolved under section 11 of the Terms of service (binding individual arbitration in Pinellas County, Florida, with class action and jury trial waivers), and otherwise only in the state courts located in Pinellas County, Florida, or the United States District Court for the Middle District of Florida.
